Terms and Conditions
Welcome to Auckland by Bike. Please read these Terms and Conditions carefully before renting a bike. By renting a bike, you agree to abide by these terms.
1. General
These Terms and Conditions (“Terms”) apply to all bicycle hires arranged through Pahikara Limited trading as Auckland by Bike (“Auckland by Bike”, “we”, “our”, “us”). By making a booking, the customer (“you”, “the hirer”) agrees to be bound by these Terms.
Auckland by Bike operates in Auckland, New Zealand and provides the hire of bicycles and related equipment for recreational use.
2. Bookings and Payments
A 50% down payment of the total hire fee is required at the time of booking to confirm your reservation.
The remaining balance is payable at the start of the hire period, before bikes are released.
Payments can be made by credit card or other accepted payment methods.
3. Security Deposit
A security deposit of NZD $500 per bike will be authorised on your credit card prior to the hire period.
This is a pre-authorisation only and will not be charged unless:
- the bike or equipment is returned damaged, missing, or excessively dirty; or
- additional charges apply under these Terms (e.g., late return).
The authorisation will be released once all bikes and equipment are returned in satisfactory condition.
4. Cancellations and Refunds
By the Customer
Cancellations must be made in writing (email is acceptable). The following cancellation policy applies:

| More than 14 days | $50 administrative fee deducted from down payment; balance refunded |
| Between 14 and 2 days | 75% of the down payment retained |
| Less than 2 days | No refund of down payment |
No refunds will be given for early returns or unused hire periods once the hire has commenced.
Cancellation by Auckland by Bike
We reserve the right to cancel at any time for any reason. We will only cancel due to weather if an 'Severe' weather event is declared
Cancellation by us will result in a full refund
5. Hire Period
The hire period begins when the bike(s) are collected and ends when they are returned to Auckland by Bike.
Late returns may incur additional charges.
Bikes must not be left unattended or unsecured in public areas.
6. Minimum Age
The minimum age for hire is 18 years of age. Proof of age may be required. Riders 16 to 18 years old can be accompanied by their parent / legal guardian . The waiver for riders 16 to 18 years old will need to be signed by the legal guardian
7. Rider Responsibilities
By accepting the hire, you agree to:
Use the bike safely, responsibly, and in accordance with New Zealand road rules and regulations.
Wear a helmet at all times while riding (provided as part of the hire).
Not permit any other person to use the hired bike unless they are also registered with Auckland by Bike.
Immediately report any damage, loss, or mechanical issues.
The hirer is liable for any loss or damage to the bike or equipment during the hire period (excluding reasonable wear and tear).
8. Liability and Waiver
All riders will be required to sign a No Liability Waiver prior to commencing the hire.
By signing, riders acknowledge that cycling carries inherent risks and that Auckland by Bike, its directors, employees, and agents are not liable for any injury, loss, or damage arising from participation, except where required by New Zealand law (including the Consumer Guarantees Act 1993).
You accept full responsibility for your own safety and the safety of others while using the hired equipment.
9. Equipment Condition
All bikes and equipment are inspected and maintained to a high standard.
You are encouraged to inspect the bike before departure and confirm that it is in good working order.
Any issues should be reported before leaving the hire premises.
10. Insurance and Liability
Insurance coverage is not provided unless specified. You are responsible for any damages or injuries resulting from rental use.
We are not liable for any accidents, injuries, or damage that occur during the rental period.
11.Damage and Theft
You are responsible for any damages or theft during the rental period.
In case of theft, you must report it to the police and inform us immediately.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts.
13. Acknowledgment of Risks
The Participant acknowledges that cycling, bicycle rental, guided rides, and related activities involve inherent risks, including but not limited to: collision with vehicles, other riders, or objects; falls; equipment failure; adverse weather; road or path conditions; and the actions or negligence of third parties.
The Participant confirms that they understand these risks and that injuries may be severe, including the risk of serious harm or death.
The Participant declares that they are physically fit, competent to operate a bicycle, and not aware of any medical condition that would make participation unsafe.
The Participant voluntarily participates in bicycle rental and related activities entirely at their own risk.
The Participant accepts full responsibility for assessing whether conditions are safe for cycling, including traffic, environment, weather, and their own skill level.
14. Waiver of Liability
To the fullest extent permitted by New Zealand law, including the provisions of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, the Participant releases and forever discharges the Company (including its directors, employees, contractors, guides, and agents) from all liability for any loss, damage, injury, or death suffered by the Participant arising out of or in connection with the rental, use, or operation of any bicycle or participation in any related activity.
This waiver does not limit the Participant’s rights where liability cannot be excluded under New Zealand law.
15. Indemnity
The Participant agrees to indemnify and keep indemnified the Company against all claims, costs, damages, liabilities, and expenses arising from:
- (a) the Participant’s use or misuse of the bicycle or equipment;
- (b) any negligent, reckless, or unlawful act or omission by the Participant;
- (c) damage to property or injury to any third party caused by the Participant.
16. Safety Obligations
The Participant agrees to:
- wear an approved helmet at all times as required by New Zealand law;
- comply with the road rules and all other applicable laws;
- follow the instructions of Company staff and guides;
- not operate the bicycle under the influence of alcohol, drugs, or impairing substances.
17. Personal Property and Insurance
The Participant acknowledges that personal items are carried at their own risk and the Company has no liability for loss or theft.
The Participant is encouraged to obtain personal accident or travel insurance.
